Personal data processing information

I. Purpose of Data Processing

The minister responsible for regional development (the Minister) collects and processes your personal data in order to perform the Minister’s obligations arising from legal provisions, in particular to ensure information and promotion regarding the European Funds in Poland, including running websites and organizing meetings and conferences.

II. Legal Basis for Processing

Data processing is carried out in accordance with the GDPR[1]. The legal basis for processing in the scope of operating websites, organizing conferences, trainings, and consultations (including participant registration) is the necessity to perform obligations (Art. 6(1)(c) and (e) GDPR) arising from:

  1. The Act of 11 July 2014 on the principles of implementing programs in the field of cohesion policy financed in the 2014–2020 financial perspective,
  2. The Act of 28 April 2022 on the principles of implementing tasks financed from European funds in the 2021–2027 financial perspective,
  3. Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021 laying down common provisions on the European Regional Development Fund, the European Social Fund Plus, the Cohesion Fund, the Just Transition Fund and the European Maritime, Fisheries and Aquaculture Fund, as well as financial rules for those funds and for the Asylum, Migration and Integration Fund, the Internal Security Fund and the Instrument for Financial Support for Border Management and Visa Policy (the so-called Common Provisions Regulation).

The legal basis for processing with regard to running a newsletter is the consent of the data subject to the processing of their personal data, such as an email address (Art. 6(1)(a) GDPR).

III. Data Retention Period

Personal data will be stored for the duration of information and promotion activities, including for as long as the websites are operational. In the case of registration/consultation forms, the data are processed until the event for which registration took place is completed / until the consultation process ends, and in the case of newsletter subscriptions – until the user withdraws consent (via the withdrawal form).

IV. Types of Data Processed

The Minister collects and processes, in particular, the following personal data:

  1. Identification data, in particular: name, surname, place of employment/type of business activity, position,
  2. Contact details, including in particular: email address, telephone number, fax number, correspondence address,
  3. Image, including photos/videos in which you are visible, taken during events organized by the Minister,
  4. Information about your activity within the website (e.g. logs and cookies).

V. Obligation to Provide Data

Providing personal data on the Ministry’s websites is voluntary. If you do not provide personal data, it will not be possible to provide information or participate in meetings or conferences organized by the Minister.

VI. Access to Personal

Data Access to your personal data is granted to employees and associates of the Ministry. In addition, your personal data may be / are entrusted or disclosed to:

  1. Entities providing the Minister with services related to the operation and development of ICT systems and ensuring communication, in particular IT solution providers and telecommunications operators,
  2. Entities entrusted by the Minister with carrying out tasks related to the management of European funds, in particular entities acting as intermediary and implementing institutions, as well as European Funds Information Points (especially in relation to providing information about the funds).

VII. Rights of Data Subjects

You are entitled to the following rights:

  1. Right of access and rectification The data subject may ask the Minister, among others, whether the Minister processes their personal data, what data are processed and from what source, the purpose and legal basis of the processing, and how long the data will be processed.
  2. Right to update data If processed data turn out to be outdated, the data subject may request their update.
  3. Right to erasure or restriction of processing – if the conditions set out in Articles 17 and 18 GDPR are met. The request for erasure is carried out in particular when further processing is no longer necessary to achieve the Minister’s purpose or when personal data have been processed unlawfully. Detailed conditions are set out in Article 17 GDPR. For data collected on the basis of consent (newsletter subscriptions), you have the right to withdraw consent for the processing of personal data (i.e. email address) at any time by filling out the form: www.funduszeunijne.gov.pl/wycofanie-zgody Restriction of processing means that the Minister may only store personal data. The Minister may not transfer, modify, or delete them. Restriction is temporary and lasts until the Minister assesses whether the personal data are correct, lawfully processed, and necessary for the processing purpose.
  4. Right to lodge a complaint with the President of the Personal Data Protection Office.

VIII. Automated Decision-Making

Your personal data are not subject to automated decision-making, including profiling.
